Terms of Service

1. Overview

FreeDonateButton is a free, open-source donation platform operated by Make More Marbles Foundation, a 501(c)(3) nonprofit organization (EIN: 92-2489150). These Terms of Service ("Terms") govern your use of the FreeDonateButton website, widget, and associated services (collectively, the "Platform").

By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. Service Description

FreeDonateButton provides:

• A donation widget that nonprofit organizations can embed on their websites
• Stripe Connect onboarding to route donations directly to each charity's Stripe account
• A landing page at freedonatebutton.org with a live demo and savings calculator

FreeDonateButton charges zero platform fees. The only fees are Stripe's standard payment processing fees (currently 2.2% + 30¢ per transaction for US cards).

3. Eligibility

To use the Platform as a charity:

• You must be a legitimate nonprofit or charitable organization
• You must have or create a Stripe account
• You must comply with Stripe's Terms of Service and Connected Account Agreement
• You must use the Platform for lawful charitable purposes only

4. Payment Processing

All payment processing is handled by Stripe, Inc. under their terms. When a donor makes a contribution through a FreeDonateButton widget:

• The payment is processed by Stripe and deposited directly into the charity's connected Stripe account
• FreeDonateButton never holds, touches, or has access to donated funds
• Stripe's standard processing fees apply to each transaction
• Refunds and disputes are handled through Stripe's dashboard by the charity

5. Charity Responsibilities

If you use FreeDonateButton as a charity, you are responsible for:

• Providing accurate organizational information during onboarding
• Issuing tax receipts to donors as required by law
• Complying with all applicable laws regarding charitable solicitation
• Maintaining your Stripe account in good standing
• Handling donor inquiries and refund requests

6. Prohibited Uses

You may not use the Platform to:

• Solicit donations for fraudulent or illegal purposes
• Impersonate another organization
• Engage in money laundering or terrorist financing
• Circumvent rate limits or security measures
• Collect personal data from donors beyond what Stripe processes
• Use the widget to process non-donation payments (e.g., product sales)

7. Intellectual Property

The FreeDonateButton widget code, website design, and branding are the property of Make More Marbles Foundation. Charities are granted a non-exclusive, revocable license to embed the widget on their websites for donation purposes.

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, and we are not liable for Stripe outages, failed transactions, or payment disputes.

9. Limitation of Liability

To the maximum extent permitted by law, Make More Marbles Foundation and its officers, directors, and volunteers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to lost donations, lost data, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless Make More Marbles Foundation from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your organization's charitable activities.

11. Termination

We reserve the right to terminate or suspend access to the Platform at any time, with or without cause. Charities may stop using the Platform at any time by removing the widget from their website.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
